Welcome to Pujo. These Terms of Service ("Terms") govern your access to and use of the website pujo.ai, our SMS-based conversational service, and any related services (collectively, the "Services") operated by Pujo AI, Inc. ("Pujo," "we," "us," or "our").
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
SMS & Text Messaging (A2P) Disclosure.
By using Pujo, you agree to receive texts about your mobile apps. You opt in by texting our published number (typically after tapping a “Text Pujo” link on pujo.ai); sending your first message consents to SMS replies from Pujo.

No mobile information is shared with third parties or affiliates for marketing or promotional purposes. See Section 5: SMS Communications for full details, and our Privacy Policy.
You must have the legal capacity to enter into a binding agreement to use the Services. By using the Services, you represent that you meet this requirement. The Connect to the cloud step requires a Google Cloud account with billing enabled, which is provided by Google and governed by Google's own terms.
If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Pujo provides a conversational AI service that helps users design, build, and launch websites and related digital products through text messaging and other interfaces. The Services include:
Pujo is an evolving product. We may add, modify, or remove features at any time.
You retain ownership of content you submit to Pujo, including messages, images, project descriptions, and other materials ("User Content"). You grant Pujo a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your User Content solely to operate and improve the Services and to provide the outputs you request.
Pujo generates websites, code, designs, and other artifacts based on your requests ("Generated Outputs"). Subject to your compliance with these Terms, you own the rights to Generated Outputs created for you, except that:
You are responsible for your User Content and your use of Generated Outputs. You represent that you have all necessary rights to submit User Content and that it does not violate any law or third-party rights.
We may use Content to train and improve our AI models, including future specialized models built on user interactions with the Services. Training data may include conversation content, generated outputs, and metadata. We anonymize personal identifiers before using data for model training. You may opt out of having your Content used for AI model training by contacting privacy@pujo.ai.
You agree not to use the Services to:

Pujo's primary interface is SMS (text messaging). The following terms apply to SMS communications:
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors supporting the delivery of the SMS service itself (such as our messaging infrastructure providers) is permitted. All other categories of data sharing exclude mobile opt-in data and consent.

Some features of the Services may require payment. If you use paid features, you agree to pay all applicable fees as disclosed at the time of purchase. Fees are non-refundable except as required by law or as otherwise stated.
Pujo may change pricing at any time with reasonable notice.
Message and data rates from your mobile carrier may apply to SMS communications and are your responsibility.
The Services, including the Pujo name, logo, mascot, software, and all related materials (excluding User Content and Generated Outputs), are owned by Pujo AI, Inc. and its licensors and are protected by intellectual property laws. These Terms do not grant you any rights to use Pujo's trademarks, logos, or branding without our prior written consent.
The Services may integrate with or rely on third-party services (such as hosting providers, messaging providers, and AI model providers). Your use of third-party services is governed by their respective terms and privacy policies. Pujo is not responsible for third-party services.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. Pujo disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
Pujo does not warrant that:
You are responsible for reviewing, testing, and validating any Generated Outputs before relying on them or deploying them publicly.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Pujo, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with the Services or these Terms, whether based on warranty, contract, tort, statute, or any other legal theory.
Pujo's total cumulative liability arising out of or related to these Terms or the Services shall not exceed the greater of (a) one hundred US dollars ($100) or (b) the total amount you have paid to Pujo in the twelve months preceding the event giving rise to the liability.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the above limitations apply to the maximum extent permitted by law.
You agree to indemnify and hold harmless Pujo, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:
You may stop using the Services at any time. Pujo may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms.
Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any disputes arising out of or related to these Terms or the Services shall be resolved in the state or federal courts located in Santa Clara County, California, and you consent to the jurisdiction of those courts.
We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last Updated" date and, where appropriate, by other means. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
These Terms constitute the entire agreement between you and Pujo regarding the Services. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision is not a waiver of that right or provision.
